Millbrook Jack’s Employee accused of stealing night deposits for gambling addiction

On February 20, 2024, Millbrook detectives placed Kyle Simmons, a 33-year-old Millbrook resident under arrest on (2) counts of Theft of Property 2nd Degree pursuant to an investigation into (2) thefts of currency from Jack’s restaurant, located at 1235 Highway Millbrook, AL.

Simmons, who was employed by the restaurant at the time of the reported thefts, was responsible for making bank deposits upon completion of his assigned shift. It is alleged that Simmons failed to make bank deposits on two different dates, instead taking the proceeds for his personal use. When confronted by management about the funds not being deposited in the designated bank, as dictated by protocol, the alleged offender admitted that he’d taken the money to fuel his gambling addiction. Management immediately contacted the Millbrook Police Department, who responded to the business and detained Simmons, who was detained and transported to the Millbrook Police Department. He was then turned over to detectives with the department’s Criminal Investigations Unit.

Simmons was placed under arrest, being charged with (2) counts of Theft of Property 2nd Degree and later transported to the Elmore County Jail.

It’s not unusual to see cases like this. Far too many people that occupy positions of trust, such as the alleged offender in this case, think they can “borrow” money from a business for whatever their motivation, and that they’ll be able to replace the money without the business ever knowing that the money was missing. In most cases, they are unable to replace the money and the business discovers that a theft has occurred. More often than not, the person responsible winds up being charged with a criminal offense and also ends up unemployed as result.
